coverage issues facing the insurance industry as they relate to environmental tort cases. Despite similar factual
circumstances and policy language, interpretations have varied state by state and/or court by court.
This booklet provides an overview of insurance coverage and environmental tort cases in the U.S. States and Canadian provinces. Case citations are also
provided for other types of claims that may give insight into a particular jurisdiction’s proclivities.
Since these reviews provide only a brief summary, a complete reading and analysis of the cases, coupled with
specific legal opinions of the applicable jurisdictional laws, must be completed before significant
